Sam Bernstein Law Firm Supports Ban on Texting to Eliminate Michigan Auto Accidents

Texting while driving has become a serious issue in the state of Michigan, causing numerous Michigan car accidents and car accident injuries. After passing both the Senate and the House, the ban on texting while driving makes it punishable as a secondary offense. Drivers must be pulled over for a different reason, such as speeding or driving recklessly, in order to receive a texting ticket.

A new version of the bill was amended by Senate last month to make texting while driving a primary offense, according to state Sen. Roger Kahn. The initial version of the bill did not specify fines, but in the amended version, the Senate pushed for a 0 fine for first time offenders, and 0 for each violation after. They hope the steep fines will provide incentive for drivers to stop distractions while driving and decrease car accidents and car accident injuries.

Michigan State Police support the primary offense version of the bill, stating that it would be a greater deterrent if people could be pulled over for texting.

If the Senate version of the bill passes, the law could go into effect as early as July 1, 2010. Texting while driving is already considered a primary offense in 15 states.

According to research by the Federal Motor Carrier Safety Administration, drivers who send and receive text messages take their eyes off of the road for an average of 4.6 seconds out of every 6 seconds while texting. These statistics make it easier for drivers to miss a sudden turn or fail to see an obstruction in the road, increasing the number of auto accidents.

An estimated 1.6 million crashes every year are caused by drivers texting and using cell phones, said Sen. John Pappageorge, a supporter of the bill.

According to the National Highway Traffic Safety Administration, nearly 80 percent of auto accidents and 65 percent of near-auto accidents involve some form of driver inattention. The most common distraction is texting while driving.

2. Whether you are doing a driveway, road or parking lot – keep your design simple and focus on the foundation of the surface. Use rock, as it’s relatively inexpensive and will help the strength of the surface.

3. Emphasize aesthetics over functionality. If you are trying to sell a house, you may be able to do some simple maintenance that will enhance the appearance.

4. Do your homework before choosing an asphalt contractor. See if they have a website which will allow you to look to see their workmanship. Check references as well and go watch them on an existing job.

5. Don’t get scammed by “traveler” contractors. Many, “want to be” asphalt contractors will travel hundreds of miles from their home state to pick up jobs. Unfortunately, these “travelers” scam unsuspecting customers out of their hard earned dollars. Be
careful who you choose to do your asphalt project (see item 4 above).

U.S. government sanctions 5 million to prevent foreclosures in Michigan

Michigan homes saw a decline in prices by 20% or more in 2009 due to the increased number of foreclosures and Metro Detroit was one of the hardest hit areas where home values dipped to as low as few hundred dollars. Many homeowners working at the three motor companies fled the state in search of new job opportunities and a number of cheap foreclosure properties were created because many homeowners could not pay back the mortgages as they lost jobs.

These foreclosure properties were offered at one-fourth the market price by the banks to investors and many overseas investors invested in bulk buying to own cheap properties. Foreclosure properties had been a drag on property prices and therefore, the government offered to invest 4.5 million in Michigan to prevent mortgage defaults. A total of 1.5 billion has been sanctioned by the U.S. government to prevent foreclosures in five states which includes Michigan, California, Nevada, Arizona and Florida. According to the new plan Arizona will receive 5.1 million, Florida 8 million, California 9.6 million and Nevada 2.8 million.

Home values in these five states has decreased by an average of twenty percent and after the allocation of initial round of funds the government will allocate 0 million to cure unemployment in these states. The plan was submitted to get approval from the Treasury Department in the month of April and to qualify to get the benefit from the new program, the home owner should live in the house and pay the mortgage amount for the next five years, otherwise, the homeowner will have to pay back the money.

About .8 million has been sanctioned for the Unemployment Mortgage Subsidy program in which the government will pay half of the mortgage amount for the unemployed workers and the upper limit for the amount is 0 per month.

.5 will be given for the Loan Rescue Program, in which, the government will pay ,000 to the homeowners to pay back mortgages, and .4 million will be given for the Principle Curtailment Program, in which, the homeowners can refinance the mortgages and ,000 will be provided to the homeowners through the program. The amount will be provided to the people who owe more in mortgages than their home’s worth.

The steps will prevent further foreclosures in the state and will provide relief to unemployed as it is found that 57% of the mortgage delinquencies were caused by job loss and the latest plan will not only benefit unemployed but also underemployed borrowers. The funds will help more than 17,000 Michigan households by preventing foreclosures which includes 11,000 families that are even drawing the unemployment benefits.

Reconnecting with each other requires very tender time. “Seeing so much open countryside is really comforting to people in the armed forces,” remarks Ruth, “They feel very secure really quickly. The muddier the forest, the better, as the rain helps the morels. No mosquitoes are present at that time of year.
